Access to data from Central Register of Vehicles

 

1. Access to data from the Central Register of Vehicles is governed by the Road Traffic Law, which is classified as administrative law, not civil law, and the procedure follows the Administrative Procedure Code.

 

2. Under Administrative Procedure Code Art. 80c(4), providing access to data in the register lies within the discretion of the Minister of Interior. The applicant must persuade the minister of the need for specific data, but demonstration of a justified  interest does not mean the minister is required to provide the data. The justification must be supported by facts and evidence (Art. 80). Documents that are not in Polish must be translated into Polish if they are to serve as evidence (Polish Language Act).

 

3. The Road Traffic Law and the executive regulation on the Central Register of Vehicles do not specifically require enclosure of a payment order or judgment with an enforcement clause, but these are examples of types of documents that may help demonstrate a justified interest in access to data from the register.
